Terms of Service

These Terms of Service govern access to and use of the websites, software, and related services provided by FUNZPLAY MEDIA LIMITED (“FUNZPLAY”). By using the services, you agree to these Terms. If you use FUNZPLAY for an organization, you represent that you are authorized to accept these Terms on its behalf.

1. Service

FUNZPLAY provides business intelligence, campaign reporting, creative management, advertising measurement, and advertising workflow services for game advertisers. Product features may evolve as we improve the service and add approved platform capabilities.

2. Accounts and Organizations

You are responsible for maintaining accurate information, protecting your credentials, and keeping workspace access current. Organization administrators are responsible for users, roles, permissions, connected services, and business data in their workspace.

3. Customer Data

You retain ownership of data that you submit, upload, or connect to FUNZPLAY. You grant us the rights necessary to host, process, transmit, display, and analyze that data to provide and improve the service. You are responsible for ensuring that you have the rights and permissions needed to provide, upload, or connect the data.

4. Connected Advertising Services

If you connect TikTok or another third-party service, you authorize FUNZPLAY to access and process only the data available under the permissions you grant. You may connect only accounts that you own or are authorized to manage. Your use of each third-party service remains subject to that service’s terms, policies, and authorization controls.

5. Acceptable Use

You may not use FUNZPLAY to:

• Violate laws, regulations, advertising platform policies, or third-party rights.
• Access or manage data, accounts, campaigns, or creatives without authorization.
• Bypass security, permission, rate-limit, or platform controls.
• Upload malicious code or interfere with the service or connected services.
• Misrepresent advertising performance, attribution, authorization, or business results.
• Make unlawful, discriminatory, deceptive, or unauthorized advertising decisions.
• Resell, sublicense, or misuse data obtained from a connected advertising platform.

6. Analytics and Decisions

FUNZPLAY may provide reports, alerts, analysis, and recommendations. These outputs are informational and should be reviewed by qualified personnel. You remain responsible for business decisions and advertising actions taken using the service.

7. Confidentiality

Each party may receive confidential information from the other. Confidential information must be protected with reasonable care and used only for purposes related to the service.

8. Fees and Payment

Paid services, if applicable, are governed by the relevant order form, subscription terms, or written agreement. Unless a separate agreement or applicable law states otherwise, fees are non-refundable.

9. Suspension and Termination

We may suspend or terminate access if you violate these Terms, create a security or platform risk, fail to pay applicable fees, or use the service in a way that may harm FUNZPLAY, customers, advertising platforms, or third parties. You may stop using the service at any time.

10. Disclaimers

The service is provided on an “as is” and “as available” basis to the extent permitted by law. We do not guarantee uninterrupted operation, error-free outputs, API availability, approval by any third-party platform, or any specific advertising or business result.

11. Limitation of Liability

To the maximum extent permitted by law, FUNZPLAY will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, or business interruption.

12. Changes

We may update these Terms from time to time. If changes are material, we will provide notice where required. Continued use after updated Terms become effective constitutes acceptance of the changes.
